Terms of Service

Welcome to Lulu! These Terms of Service ("Terms") govern your access to and use of Lulu (the "App"), operated by Shophouse AI Pte. Ltd. ("we," "us," or "our"). By using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 18 years old or have parental/guardian consent if you are under 18. You also agree to comply with these Terms and all applicable laws and regulations.

2. User Responsibilities

You are solely responsible for the content you upload, share, or create on the App ("User Content"). By uploading content, you confirm that:

  • You own or have the necessary rights and permissions to upload the content.
  • Your content does not infringe on any copyright, trademark, privacy, publicity, or other rights of third parties.
  • Your content complies with all applicable laws and our Community Guidelines.

You agree not to:

  • Upload content that is illegal, offensive, defamatory, obscene, or otherwise inappropriate.
  • Use the App to harass, intimidate, or harm others.
  • Misrepresent your identity or impersonate others.

3. Content Ownership and License

You retain ownership of any User Content you upload. By submitting content to the App, you grant us a non-exclusive, worldwide, royalty-free license to host, display, reproduce, modify, adapt, publish, and distribute your content as necessary to operate and improve the App.

In addition to operating the App, we may analyze aggregated usage trends, user interactions, and feedback to enhance existing features, develop new functionalities, and improve overall user experience. We do not claim ownership of your content and will only use it as described in these Terms and our Privacy Policy.

4. Prohibited Content and Activities

The following are prohibited on Lulu:

  • Violating export control or sanctions laws applicable in your country or Singapore.
  • Uploading copyrighted material without authorization.
  • Sharing personal information of others without their consent.
  • Posting harmful or malicious software.
  • Engaging in fraudulent or deceptive practices.

We reserve the right to remove any content that violates these Terms or applicable laws.

5. Compliance with Copyright and Hosting Laws

We comply with applicable copyright laws, including the Digital Millennium Copyright Act (DMCA) in the U.S. and the EU E-Commerce Directive, to limit our liability for user-generated content as a neutral intermediary. As such:

  • We act as a hosting provider and do not actively monitor or modify user content.
  • Upon receiving valid notifications of illegal content or copyright infringement, we will remove or disable access to the content promptly.
  • We maintain a designated DMCA Agent for receiving copyright infringement notices.

If you believe content on the App infringes your copyright, please report it to us at info@genlulu.com with the following information:

  • Your contact information.
  • A description of the infringing content and its location on the App.
  • A statement that you have a good faith belief the use of the content is unauthorized.
  • A declaration that the information in your notice is accurate, under penalty of perjury.

For EU users, reports of illegal content can be submitted to info@genlulu.com, and we will address these in compliance with the EU E-Commerce Directive.

6. Reporting and Takedown Policy

If you believe content on the App violates these Terms, you can report it to us at info@genlulu.com. We will investigate and take appropriate action, which may include removing the content or disabling the user account.

7. Account Security

You are responsible for maintaining the confidentiality of your account information. Notify us immediately if you suspect unauthorized use of your account. We are not liable for any loss or damage resulting from your failure to secure your account.

8. Termination of Use

We reserve the right to suspend or terminate your access to the App at our discretion, including for:

  • Violations of these Terms.
  • Illegal or harmful activities.

You may delete your account at any time by contacting us at info@genlulu.com.

9. Disclaimer of Warranties

The App is provided "as is" and "as available." We do not guarantee that the App will be error-free, secure, or available at all times. To the extent permitted by law, we disclaim all warranties, express or implied.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the App or inability to access it.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, liabilities, damages, or expenses (including legal fees) arising from your use of the App or violation of these Terms.

12. Modifications to the Terms

We may update these Terms from time to time. We will notify you of significant changes by posting an updated version on the App or through other means. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of Singapore, without regard to its conflict of laws principles. If you are a consumer residing in the European Union, the laws of your country of residence may apply where mandatory consumer protection laws require it.

Any disputes arising from these Terms or the App will first be attempted to be resolved through amicable negotiations. If unresolved, the dispute will be referred to binding arbitration administered by the Singapore International Arbitration Centre (SIAC) under its Rules of Arbitration. The arbitration will be conducted in English.

Nothing in this clause prevents you from bringing claims in your local jurisdiction if mandatory laws permit.
